It has been confirmed that a number of fake emails in the name of “LDH JAPAN Inc.” and LDH’s artists or talents were recently sent to an unspecified number of people, which stated that they “infringed copyrights or portrait rights”.

The content of the email is as follows.

私どもは、LDH Japan株式会社以下、当社でございます。

まず初めに、貴社が当社の音楽作品に関連する著作権を侵害している事実を確認したことについてお知らせ申し上げます。当社が所有する音楽著作物に関して、貴社が無断で使用・配信等を行っていることが発覚しました。この行為は、著作権法第21条から第28条に基づく権利の侵害に該当します。

当社は、著作権法を尊重し、音楽著作物の不正使用を防止するために必要な措置を講じる所存です。したがって、貴社には以下の対応を求めます。

速やかに当社の音楽作品の使用を中止し、すべての配信・公開を停止してください。
著作権侵害に関する詳細な説明と謝罪文を当社に提出してください。
著作権侵害により生じた損害の賠償について、当社との協議を開始してください。
上記対応について、3日間までにご連絡をいただけますようお願い申し上げます。万が一、この期限までに適切な対応がなされない場合、法的手続きを講じることを検討せざるを得ません。

当社としては、円満に解決を図りたいと考えておりますが、著作権侵害に対する法的措置は厳格に行う所存でございます。
